The Terms of Service ("Terms") help you understand the relationship and agreement between you ('users', 'you', 'your') and Potomix ('our app', 'we', 'us', 'our'). This agreement sets forth the general terms and conditions of your use of the Potomix mobile application and any of its products or services ('mobile application' or 'services'). To provide better services, please read the Terms of Service carefully before you start using our app and its related services.
If you are under the age of 16 or if you are over 16 but under the legal age of majority in your state of residence, please read and fully understand this agreement with your legal guardian and use our app and related services only with their consent.
Unless you fully accept and agree to all contents of this agreement, do not download, install, or use our app or its related services in any way. By using our app and related services, you are deemed to have fully understood this agreement and undertake to accept these Terms as a party to this agreement.
This agreement is between you and Potomix for the download, installation, and use of Potomix and its related services. Some services may be provided by third-party companies, and you understand and agree to accept the above service contents, which not only constitutes acceptance of the relevant rights and obligations between the parties but also binds you to this agreement.
'You' means any user who directly or indirectly uses Potomix and its related services, including natural persons, legal persons, and other organizations, referred to as "you" or "User" in this Agreement.
'Potomix' means the application named "Potomix" and its related services provided on the App Store, other platforms, or websites. Potomix provides functions to edit photos, take photos, and other functions that we may update in the future.
The contents and services of our app may be provided according to actual circumstances, and we may change the services or contents, including but not limited to adding new services, removing existing services, etc. The content of the services may be changed at any time, and we may provide explicit or implied notices through the app; changes to free services may not be separately notified.
Our app can be downloaded and installed from the App Store, our website, and other authorized third-party platforms. If you use our app or related services from unauthorized third-party platforms, we cannot guarantee the availability of the app or services, nor will we be responsible for any losses you may incur.
Our app provides services to edit and take photos, as well as any other services we may offer. You may use these services by downloading and installing our app.
Users understand and accept that our app only provides related network services. Equipment related to these services (such as personal computers, mobile phones, and other devices for accessing the Internet or mobile Internet) and associated fees (e.g., telephone and Internet access fees, mobile data fees) are the user's responsibility.
Our app provides AI effects, which require you to upload photos to our server for processing. Uploading photos is necessary to use these AI effects. Protecting your data and privacy is always our priority. For more details on how we collect and protect your privacy, please refer to our Privacy Policy. Accepting this agreement means you fully understand and agree to be bound by these Terms.
To improve the app experience, users who upload content (including but not limited to text, images, audio, video, live content, and other forms, as well as music, sounds, dialogue, visual designs, etc.) grant our app and its controlling company worldwide, free, non-exclusive, sublicenseable (through multiple levels) rights (including but not limited to reproduction, translation, compilation, information network communication, adaptation, derivative works, performance, and display rights). The scope of these rights includes use on current or future websites, applications, products, or terminal devices.
Users acknowledge and agree that our app has the right to use, for any promotion, advertising, marketing, or research related to the product, the content (in whole or in part) uploaded by users or licensed by third parties.
For clarity, users understand and agree that the rights granted above include the use, reproduction, and display of personal images, likenesses, names, trademarks, service marks, brands, logos, and any other branding, marketing, or promotional assets embedded in the content.
You understand that the app experience is constantly improving, and we may update the app version. If possible, we will prompt you via methods including but not limited to system pushes or in-app pop-ups. You may choose to accept the update; if not, some functions may be limited or unavailable. If you no longer wish to use our products or services, you may uninstall the app. Uninstalling the app means your data will no longer be retained on your device or our servers, and users are responsible for any resulting losses.
Your privacy is important to us. We provide a 'Privacy Policy' to disclose how we collect and use your information. We encourage you to read the policy carefully to make informed decisions.
Users understand and accept that our app may include advertisements as a reasonable and legal business model and agree to view ads provided by our app, third-party suppliers, and partners during use of the network services.
Our app and third-party partners will comply with laws regarding ad placement, but you should judge the authenticity of ad information independently and bear responsibility for your decisions. Our app is not liable for any loss or damage from transactions with advertisers or their content.
If you disagree with the ads, you may stop using our app and related services. For push notifications, you may disable the service or uninstall the app.
We may amend these Terms from time to time and will inform you appropriately based on the significance of the changes (e.g., via in-app pop-ups or push notifications). Please check for updates regularly; continuing to use our app means you accept the new terms.
Due to the nature of network services, users agree that we may change, interrupt, or terminate part or all of the network services, or change the owner or operator of the services, at any time for business reasons, without notice and without liability to users or third parties.
We reserve the right, at our sole discretion and without notice, to terminate your right to use our app, and we are not liable for any losses from inability to use the app.
You may fully and permanently remove the app from your device at any time to terminate this agreement.
Our app holds full intellectual property rights to all versions, technologies, programs, materials, props, and information content (including but not limited to product functions, user interfaces, operating procedures, trademarks, patents, computer software works, etc.). A license to use the software does not transfer any intellectual property rights to you. Any content you download or use in our app is limited to personal entertainment, study, research, or appreciation and may not be used commercially without our written consent.
All text, pictures, graphics, audio, and video materials in our app's network services are protected by copyright, trademark, or other property laws. Without consent from relevant right holders, these materials may not be used for commercial purposes.
All rights to the content and related services (including but not limited to images, photos, animations, videos, audio, music, text, additional programs, and help materials) used by our app belong to our company. Without permission, users shall not reverse-engineer, decompile, disassemble, or perform similar acts to obtain source code. Users are responsible for all legal consequences of such actions, and we will pursue legal liability.
Users agree that we are exempt from liability for losses caused by force majeure or other factors during use, including but not limited to political events, social environment, natural disasters, economic crises, computer viruses, hacker attacks, server/system instability, your location, technical capabilities, network quality, communication lines, or computer failures ('Disclaimer').
Users understand and agree that our app may not fully meet all usage requirements.
Users understand and agree that the app may not be uninterrupted, timely, safe, reliable, or error-free; and that any software, services, or materials obtained through the app may not meet your expectations.
Users acknowledge that for the services under this agreement, the app does not provide any express or implied warranties or conditions, including but not limited to merchantability or fitness for a particular purpose. Your use of the app and related services is at your own risk.
Users acknowledge that this agreement aims to comply with national laws, maintain public order and morality, and protect others' rights. Users understand and agree to bear consequences resulting from compliance with judicial or administrative decisions.
If any provision of these Terms is unlawful, void, or unenforceable, that provision is severable and does not affect the validity of the remaining provisions.
This agreement constitutes the entire agreement between you and our products, regulating your use of the service. When using third-party services, content, or software, you must also comply with their additional terms.
Our failure to exercise or enforce any rights or provisions does not constitute a waiver of those rights.
The titles in this agreement are for convenience only and have no legal effect.
Without written authorization, users may not assign or transfer rights granted by this agreement or delegate obligations to others.
Our app has the final right to interpret this agreement.
